Special Counsel Jack Smith has released his final report on the investigation into former President Donald Trump. The report claims Smith and his team gathered enough evidence to convict Trump of trying to overturn the 2020 election results, but Trump’s election victory in 2024 made prosecution impossible. Under Justice Department rules, sitting presidents cannot be prosecuted.

The 174-page report, addressed to Attorney General Merrick Garland, details Trump’s alleged actions to interfere with the election. This included pressuring state officials to alter results, asking Georgia’s Secretary of State to “find” thousands of votes, and urging then-Vice President Mike Pence to block the certification of the Electoral College votes. Smith’s team also highlighted Trump’s role in inciting the January 6 Capitol riot, where over 140 law enforcement officers were injured, some severely.

Smith considered charging Trump under the Insurrection Act, which applies to anyone involved in rebellion or insurrection against the United States. This could have led to serious penalties, including prison time and a ban from holding public office. However, the team decided not to pursue those charges.

Trump has repeatedly denied the allegations and reacted strongly to the release of the report. He criticized Smith on his platform, Truth Social, accusing him of political bias and calling the investigation a “witch hunt.” Trump claimed the report was filled with false accusations and insisted he had done nothing wrong.

Despite Trump’s criticism, the report provides a detailed account of his alleged efforts to overturn the election and obstruct Congress during the January 6 certification process. It also emphasizes the need to protect the democratic process and ensure every vote counts.

The report also touched on Trump’s handling of classified documents after leaving the White House. While this part of the investigation was not included in the final release, it remains ongoing due to charges against Trump’s co-defendants in that case.

Smith defended the investigation, praising his team for their dedication and resilience despite public attacks and threats. He denied Trump’s claims that the investigation was politically motivated, stating that all decisions were based on evidence and legal standards.

This report concludes one of the most high-profile investigations into a former U.S. president, raising serious questions about the balance between holding leaders accountable and navigating political and legal boundaries. It also marks the end of Smith’s role in the Justice Department, as he officially stepped down after completing the investigation.
